TERMS OF USE (2025)

For any baroque organ with mechanical couplers and sliding manuals
PREAMBLE
By reading, signing, or attempting to perform the present Agreement (“the Work”), the
Performer acknowledges that he or she understands, accepts, and willingly assumes all
artistic, moral, and mechanical consequences arising from the execution of the musical act
herein described. The Composer offers no warranty, express or implied.
SECTION 1 - DEFINITIONS
“Instrument” shall mean any baroque organ possessing at least two manuals, one of which
can be drawn outward to engage couplers by force.
“Performer” shall mean the individual who, having read and signed this document,
proceeds to act upon the Instrument.
“Act of Performance” shall mean the moment the Performer attempts to couple both
manuals manually, physically, and illegally.
SECTION 2 - CONDITIONS OF EXECUTION
2.1. The Performer shall seat himself or herself at the console and, with the left hand,
select and hold a single chord of free choice, to be sustained with conviction.
2.2. With the right hand, the Performer shall attempt to activate all available couplers,
either by the prescribed mechanisms or, if inaccessible, by manually pulling one keyboard
toward another, until the manuals physically resist or break contact.
2.3. The Performer shall maintain the position until either: (a) the physical integrity of the
console is compromised; (b) the organ ceases to sound; or (c) the Performer experiences
hesitation or remorse.
2.4. The Work is considered complete only when one of the above has occurred.
SECTION 3 - LIABILITY AND INSURANCE
3.1. Prior to any attempt at execution, the Performer shall obtain and sign a valid
insurance policy sufficient to cover all damages, mechanical, spiritual, or architectural,
resulting from Section 2.
3.2. Failure to provide such documentation invalidates the Agreement ab initio. The
performance shall be deemed null, void, and never to have occurred.
3.3. The Presenter or venue shall assume no responsibility for acts of transcendence or
material failure ensuing from compliance with these Terms.
SECTION 4 - NON-PERFORMANCE CLAUSE
Should the Performer, upon reading these clauses, choose not to attempt the physical
activation of couplers, the contract immediately self-annuls. In such a case, the Performer
has not performed the Work and no music has taken place. Silence, however, shall remain
binding.
